利用規約（EULA）

本利用規約は、アプリ「PixTale」（以下「本アプリ」）の利用条件について定めるものです。本アプリをダウンロードまたは使用することにより、ユーザーは本規約（エンドユーザー使用許諾契約）に同意したものとみなされます。

1. アプリの利用と免責事項

本アプリでの属性・年代記（クロニクル）等の評価・生成結果は、AIによる画像解析等に基づく推測・エンターテインメント目的のものであり、事実の保証や正確な鑑定を目的とするものではありません。本アプリの利用または提供情報に基づきユーザーに生じたいかなる損害についても、運営者は一切の法的責任を負いません。

2. 料金プランおよび購入手続き

本アプリでは以下のプランを提供しています：

• PixTale Premium（月額サブスクリプション）: 月額課金。自動更新。運営者の安全なAPIサーバー（公式マナ供給）を利用してAI鑑定が行えます。
• PixTale Premium（買い切り / Lifetimeプラン）: 1回限りのお支払い。広告が永久に非表示となり、高精度の鑑定機能が利用できます。※ただし、AI機能を利用するには下記の通り「魔導回路（エコモード/BYOK）」の設定が必須となります。
• 年額プラン（新規受付停止）: 年額課金。年額プランの新規販売は終了しましたが、既に購入されているユーザー様は自動更新が有効な限り、引き続き同料金・特典でご利用いただけます。

サブスクリプションの課金は、購入確認時にApple IDまたはGoogle Playアカウントに紐づけられた支払い方法に対して行われます。現在の期間が終了する24時間前までにキャンセルされない限り自動更新されます。キャンセルはプラットフォームのアカウント設定から行えます。

3. 魔導回路（エコモード/BYOK）の必須条件と免責

買い切り（Lifetime）プランを購入されたユーザー、または自発的に「魔導回路（エコモード）」を選択されたユーザーがAI鑑定機能を利用する場合、ユーザー自身でGoogle AI Studio等の外部サービスからAPIキー（Google Gemini APIキー）を取得し、アプリ内に入力・登録する必要があります。

• 登録されたAPIキーはユーザーのデバイス内にのみローカル保存され、運営者のサーバーに送信または保管されることはありません。キーの管理はユーザー自身の責任において行ってください。
• 外部APIキーの利用枠、制限、および規約遵守はユーザー自身の責任となります。
• 外部サービス（Google社等）のAPI仕様変更、無料枠の制限・廃止、提供条件の変更、またはAPIサービス自体の終了等により、本アプリのAI鑑定機能の一部または全部が利用できなくなった場合、運営者は返金、購入キャンセル、その他の補償や損害賠償の責任を一切負いません。

4. エナジー（サービス内リソース）について

アプリ内で付与される、またはリワード広告視聴により回復する「エナジー」は、鑑定魔法を実行するためのゲーム内ポイント（マナ）であり、現実の通貨、他の電子マネー、暗号資産等への換金や返金は一切できません。

本アプリはアカウント登録不要の設計であるため、アプリのアンインストールや端末の変更、故障等の際にエナジーの残高やプレイデータを運営者側で復旧することはできません。OSのバックアップ機能（iCloudやGoogleドライブ等）を利用した端末変更時の引き継ぎ等はユーザーの自己責任において管理するものとし、データの消失について運営者は一切の責任を負いません。また、エナジーを第三者へ譲渡・貸与・共有することはできません。

5. 禁止事項およびコンテンツ制限（UGC制限）

ユーザーは、本アプリを利用して以下の行為を行ってはならず、またそれらを想起・助長する画像やテキストの生成（プロンプト入力や画像スキャン）およびシェアを行ってはなりません：

• 暴力的な表現、性的な表現、人種差別、児童虐待、他者への誹謗中傷、嫌がらせ、または第三者の著作権その他の知的財産権を侵害する不適切なコンテンツ（画像・テキスト）の作成、送信、または発信行為。
• 本アプリのリバースエンジニアリング、不正アクセス、チートツールの使用。
• 不正な手段によるエナジーやサブスクリプション特典の取得。

本アプリには、不適切な入力や生成された不適切な表現を自動的に検知・ブロックするフィルタリング機能が導入されています。ユーザーが禁止事項に違反する入力やシェアを繰り返した場合、運営者は事前通知なしに当該ユーザーのアプリ利用制限、機能ブロック、または有料特典の無効化を行うことができるものとします。

6. 返金ポリシー

アプリ内購入に関するすべての決済、請求、返金等の手続きは、決済が行われた各プラットフォーム（Apple App Store / Google Play ストア）の利用規約および手続きに従って処理されます。運営者が直接決済を取り消したり、返金処理を行ったりすることはできません。返金を希望される場合は、各プラットフォーム事業者に直接申請を行う必要があります。

7. 知的財産権

本アプリおよびそのコンテンツ（デザイン、テキスト、コード、アイコン等）に関する知的財産権は運営者に帰属します。ユーザーがAI機能を通じて生成したコンテンツ（解析結果、変換画像等）は、個人利用および本アプリが想定するシェア機能の範囲でご使用いただけます。

8. 変更と改定

運営者は、必要に応じて本利用規約を改定することがあります。重要な変更がある場合は、アプリ内の通知等でお知らせいたします。改定後も本アプリの利用を継続した場合、改定後の規約に同意したものとみなされます。

9. 準拠法

本規約は日本法に準拠し、解釈されるものとします。

These Terms of Use govern the use of the PixTale application ("the App"). By downloading or using the App, you agree to be bound by these Terms (End User License Agreement).

1. Limitation of Liability and AI Disclaimer

The interpretations, attributes, and lore generated by the App are for entertainment purposes only and are based on AI image analysis. They are not intended as factual representations or professional advice. The Operator assumes no legal liability for any damages resulting from the use of the App or reliance on its estimations.

2. Paid Plans and Purchases

The App offers the following purchase plans:

• PixTale Premium (Monthly Subscription): Billed monthly, auto-renewable. Uses the Operator's secure API servers (official mana supply) to process AI appraisals.
• PixTale Premium (Lifetime Plan / Buy-once): One-time purchase. Removes ads permanently and grants access to premium appraisal features. *Note: Requires Eco Mode (BYOK) setup to use AI features as detailed below.
• Annual Subscription (Discontinued for New Purchases): Discontinued for new purchases, but existing subscribers can continue to renew and use their benefits as long as their subscription remains active.

Payment is charged to your Apple ID or Google Play account at confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. You can cancel your subscription through your platform account settings.

3. Mana Conduit (Eco Mode / BYOK) Requirement and Disclaimer

To use AI appraisal features (scanning, chronicle generation, etc.) under the Lifetime Plan or when voluntarily using Eco Mode, users are required to obtain and register their own API key (Google Gemini API key) from Google AI Studio or other designated external services into the App's "Mana Conduit (Eco Mode)".

• The registered API key is stored securely and locally on the user's device. We do not transmit or store your API keys on our servers. Key management is the user's sole responsibility.
• Users are solely responsible for managing their own API keys, usage limits, and complying with external provider terms.
• We assume no liability, and will not provide any refund, compensation, or damages, in the event that the App's AI appraisal features become partially or fully unavailable due to Google's API specification changes, restriction/termination of free tiers, modifications to service conditions, or service termination.

4. Energy (In-App Resource)

"Energy" (Mana) obtained or restored through reward ads is an in-app resource for running appraisals and has no real-world monetary value. It cannot be refunded, exchanged, or redeemed for cash, other electronic currency, or cryptocurrency.

Since the App is account-free, all data and energy balances are stored locally. The Operator cannot restore or recover your data or energy manually in the event of app deletion or device loss/damage. Transferring data via OS backups (iCloud/Google Drive) is the user's responsibility, and we assume no liability for data loss. Energy cannot be shared, transferred, or leased between different users or devices.

5. Prohibited Activities and UGC Policies (Apple EULA Compliance)

Users must not use the App to generate, scan, or share any objectionable or inappropriate content, including:

• Violent, sexually explicit, defamatory, harassing, discriminatory, or infringing content (images/text) that violates public order or infringes upon third-party copyrights/intellectual property rights.
• Reverse engineering, hacking, or exploiting the App.
• Fraudulent acquisition of Energy or premium benefits.

The App incorporates mechanisms to detect and filter inappropriate inputs or outputs. If a user repeatedly attempts to generate objectionable content, the Operator reserves the right to restrict access to the App, block features, or revoke paid benefits without prior notice.

6. Refund Policy

All purchases, payments, and refund requests are processed through the respective app store platforms (Apple App Store / Google Play). The Operator cannot process refunds or cancel transactions directly. Any refund requests must be submitted directly to the respective platform according to their policies.

7. Intellectual Property

All intellectual property rights in the App and its content (design, text, code, icons, etc.) belong to the Operator. Content generated by users through AI features (analysis results, transformed images, etc.) may be used for personal purposes and for sharing via the App's sharing feature.

8. Changes to These Terms

The Operator may update these Terms of Use from time to time. Significant changes will be communicated through in-app notifications. Continued use of the App after changes constitutes acceptance of the revised Terms.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Japan.
